MGMA urges modernization of fraud and abuse laws

January 6, 2020: MGMA commented on proposed Stark Law and Anti-kickback Statute rules urging the Department of Health & Human Services (HHS) to update and relax certain outdated compliance requirements. HHS recognizes that these rules can stand in the way of clinical and financial integration, which is necessary for value-based payment reform to succeed. In particular, the Association advocated for:
  • Value-based arrangement exceptions and safe harbors;
  • Flexibility in structuring group practice compensation arrangements;
  • Protection for co-payment waivers for care management services; and
  • Simplification of the Stark Law.
