About the Webinar

Medicare rules governing "incident to" services have long been a source of confusion to physician practices seeking to maximize efficient use of clinical staff.  Recently, the OIG has turned its spotlight on incident-to claims and is questioning whether office clinical staff is legally qualified to furnish the services they are providing. CMS is taking the OIG's concerns seriously and is expected to initiate policy changes in the near future that could include more stringent credentialing of personnel and additional recordkeeping and administrative obligations. Failure to comply with Medicare policy in this area can result in significant refund obligations and possible civil monetary penalties of up to $10,000 per claim. Two national experts on Medicare legal and compliance issues faced by physician practices will lead you through this complex area and help you reduce your compliance risks.

Following this session, you will:

  1. Know all existing rules and policies governing submission of claims for Medicare for "incident to" services
  2. Understand the OIG's concerns with current incident-to billing practices and activities or arrangements that might trigger an OIG or Medicare contractor audit
  3. Be aware of possible upcoming changes in Medicare rules governing incident-to billing, including new staff credentialing requirements and reporting obligations that could have a financial impact on your practice

Robert J. Saner II, Principal

Bob Saner joined Powers Pyles Sutter & Verville in 1994. He specializes in health care and environmental law, legislation, and regulation. Mr. Saner's health practice focuses heavily on physician organizations, including professional societies, associations, medical groups, academic practices and integrated systems. His environmental and public health practice focuses on the regulation of municipal water utilities under the federal Safe Drinking Water Act and includes emerging issues in public infrastructure protection and homeland security. Prior to joining Powers Pyles, Mr. Saner was a partner in White, Verville, Fulton and Saner. From 1972 to 1974 he served in the Department of Health, Education and Welfare and the Executive Office of the President.

Rebecca L. Burke, Of Counsel

Rebecca Burke joined Powers Pyles Sutter & Verville in 1994. She has over 20 years of health care law experience. Ms. Burke's practice encompasses a broad range of regulatory and reimbursement services. She regularly represents clients before the Centers for Medicare and Medicaid Services and other federal agencies on a variety of Medicare and Medicaid payment, fraud and abuse, Stark law, coverage, coding and other issues that affect physicians, hospitals, transplant centers, diagnostic testing facilities, and various other health care providers.
